1. Company and Acceptance of Terms

TradeHeading is a software platform and service operated by NAV-TEAM LLC.

These Terms & Conditions ("Terms") govern access to and use of TradeHeading ("TradeHeading," "we," "our," or "us"), including our websites, software platform, customer management tools, communications features, and related services.

By accessing or using TradeHeading, you agree to be bound by these Terms and our Privacy Policy.

2. TradeHeading Services

NAV-TEAM LLC provides TradeHeading as a software platform designed to help contractors, service businesses, and small trade businesses manage customers, leads, estimates, jobs, appointments, follow-ups, communications, and related business operations.

Features may change, be added, or be discontinued as the platform evolves.

3. Accounts

You are responsible for providing accurate account information and maintaining the security of your login credentials.

You are responsible for activity performed through your TradeHeading account and for ensuring that your authorized users comply with these Terms.

4. Customer Data

Businesses using TradeHeading may enter and manage information about their customers, prospects, jobs, communications, and related business activities.

Businesses using TradeHeading are responsible for ensuring that they have the appropriate authority, permission, and consent to collect, store, use, and communicate with individuals whose information is entered into TradeHeading.

TradeHeading may not be used to send unlawful, deceptive, harassing, abusive, or unsolicited communications.

5. SMS and MMS Messaging Program

Enrollment and Consent

Participation in the TradeHeading SMS messaging program is voluntary.

Before receiving SMS or MMS messages, recipients must expressly opt in to receive messaging communications. Where consent is collected through a website or online form, the SMS consent choice is separate from acceptance of general Terms & Conditions and is not selected by default.

Consent to receive SMS or MMS messages is not a condition of purchasing goods or services, creating an account, requesting an estimate, scheduling an appointment, or otherwise using TradeHeading or the services of a participating business.

Types of Messages

Recipients who opt in may receive recurring text messages relating to their relationship with NAV-TEAM LLC / TradeHeading or a participating service business.

Messages may include:

• Appointment reminders and confirmations.
• Estimate and quote notifications.
• Scheduling and rescheduling information.
• Job and service status updates.
• Service notifications.
• Customer support responses.
• Customer follow-up communications.
• Other transactional or service-related communications requested by the customer.

Message Frequency

Message frequency varies based on customer activity, appointments, estimates, job status, service requests, scheduling activity, and customer communications.

Messaging is intended to be low volume and related to the recipient's interaction with NAV-TEAM LLC / TradeHeading or the participating service business.

Message and Data Rates

Message and data rates may apply depending on the recipient's wireless carrier and mobile service plan.

How to Opt Out

Recipients may opt out of SMS or MMS communications at any time by replying STOP to a message.

After a STOP request is received and processed, the recipient may receive a final confirmation message stating that they have been unsubscribed. No further recurring SMS messages will be sent unless the recipient later provides new consent.

Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages.

Message delivery may depend on carrier availability, network conditions, device settings, wireless coverage, and other circumstances outside the control of NAV-TEAM LLC or TradeHeading.

SMS Privacy and Mobile Information

NAV-TEAM LLC and TradeHeading do not sell or share mobile phone numbers, SMS opt-in information, or messaging consent with third parties or affiliates for their own marketing or promotional purposes.

Mobile information and messaging consent are used only as reasonably necessary to provide the requested TradeHeading messaging services, deliver customer communications, support platform functionality, and comply with applicable legal and telecommunications requirements.

6. Email Communications

TradeHeading may provide email communication features used for customer confirmations, estimates, appointments, invoices, follow-ups, account notices, and other business communications.

Users are responsible for ensuring that their use of TradeHeading email features complies with applicable laws and consent requirements.

7. Acceptable Use

You may not use TradeHeading to:

• Violate any applicable law or regulation.
• Send spam or unsolicited bulk communications.
• Send deceptive, fraudulent, threatening, or abusive content.
• Impersonate another person or business without authorization.
• Upload malicious software or interfere with platform security.
• Attempt to gain unauthorized access to systems or accounts.
• Use customer information in a manner inconsistent with applicable consent or privacy requirements.
• Purchase, sell, rent, or exchange SMS opt-in information or messaging consent for marketing or lead-generation purposes.

8. Subscriptions and Billing

Certain TradeHeading services may require a paid subscription. Pricing, billing frequency, usage limits, and included features may vary by plan.

Applicable fees are due according to the billing terms presented when you subscribe. Third-party payment processors may be used to process payments.

9. Third-Party Services

TradeHeading may use or integrate with third-party service providers such as payment processors, email providers, SMS providers, telecommunications carriers, analytics providers, mapping services, hosting providers, and other technology platforms.

These providers may process information as necessary to deliver functionality requested through TradeHeading. Third-party providers may not use TradeHeading SMS opt-in data for their own independent marketing or promotional purposes.

Third-party services are also governed by their own terms, privacy policies, availability, and technical limitations.

10. Service Availability

NAV-TEAM LLC works to provide reliable access to TradeHeading, but uninterrupted or error-free service is not guaranteed.

Service may be temporarily unavailable because of maintenance, upgrades, third-party provider outages, network conditions, security events, or circumstances outside our reasonable control.

11. Intellectual Property

TradeHeading, including its software, branding, designs, documentation, and related materials, is owned by NAV-TEAM LLC or its licensors and is protected by applicable intellectual property laws.

These Terms do not grant users ownership of the TradeHeading platform or its underlying software.

12. Disclaimer of Warranties

TradeHeading is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law.

NAV-TEAM LLC does not guarantee that TradeHeading will be uninterrupted, error-free, or suitable for every business purpose.

13. Limitation of Liability

To the fullest extent permitted by applicable law, NAV-TEAM LLC and TradeHeading will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

14. Suspension or Termination

NAV-TEAM LLC may suspend or terminate access to TradeHeading when reasonably necessary to address nonpayment, security threats, misuse, unlawful activity, violations of these Terms, or risks to other users or service providers.

Users may stop using TradeHeading or cancel their accounts subject to applicable subscription and billing terms.

15. Changes to These Terms

NAV-TEAM LLC may update these Terms as TradeHeading evolves or as legal, regulatory, technical, or operational requirements change.

When changes are made, the "Last Updated" date on this page will be revised. Continued use of TradeHeading after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
